Delivery regulations

These regulations supplement the “Buyers’ Regulations”. It applies in addition when you choose the delivery of your products. When you choose delivery of your products, you accept these regulations, the “Buyers' Regulations” as well as our Terms of Use.

 

Reservations and Orders

The Consumer may have the choice of collecting the products from the Seller or having them delivered. “Reservations” become “Orders” once the Consumer chooses to have their products delivered and pays and validates their order. In this case, the Consumer's order is confirmed by an order confirmation. Unless otherwise indicated in these regulations, and when their application is possible, the rules and conditions provided for Reservations apply to Orders.

Orders

The order becomes legally binding between the Consumer and the Seller at the time of shipment of the products by the Seller, subject to the rights of revocation of the conditions provided for in these regulations or the buyers' regulations.

 

Responsibility of sellers

Sellers are responsible for packaging and shipping items sold. When the seller uses a shipping or logistics service, he assumes full responsibility for delivering the order to the Consumer. When you choose to have your products delivered to you, you therefore understand that Mimelis exclusively arranges the sale on behalf of the Seller, and that consequently, there is no contractual relationship between Mimelis and yourself, both in terms of the products and you order, only on the sale and delivery of these products. Consequently, Mimelis declines all responsibility with regard to the execution of your agreement with the Seller or to the products.

Delivery condition and delivery method

The Consumer can choose the delivery method for their order based on the different delivery methods offered by the seller. Each delivery method has its own shipping costs and estimated delivery date. Delivery costs are paid at the time of ordering by the Consumer. The delivery method may or may not specify a specific carrier. However, the seller may at any time choose to deliver the order with the carrier of his choice if this does not impact the delivery conditions relating to the delivery method chosen by the Consumer.

Delivery delay

The delivery date displayed to the customer corresponds to the estimated delivery date. It is calculated based on the processing time given by the Seller, the carrier's delivery times and the buyer's delivery address. The delivery date is given as an indication to the buyer. Delivery delays from carriers, late preparation of the order by the seller, public holidays, or placing an order on a weekend may postpone this date.

Parcel tracking

The Consumer can follow the delivery status of their order by going to their personal space, “my orders” section. When the carrier allows it and when the Seller provides a tracking number, the Consumer can follow the delivery status of their order by going to the carrier's website.

Conditions for receiving an Order

  • The Consumer is responsible for verifying the completeness and accuracy of the shipment, as well as checking the condition of the products delivered.

  • The Consumer has three days from the delivery date to open a dispute against the Seller and to formulate any reservations or complaints for non-conformity or apparent defect of the products delivered. This includes, for example, the case where a package arrives damaged or already opened.

  • The dispute can be opened either directly from the order if the button is available, or by sending an email to “contact@mimelis.ch”. The Consumer must in particular provide photos of the damaged product as well as the packaging. In order for the request to be processed, the Consumer must also provide the order number or reference. Precise and clear information as to the nature of the dispute must be provided, otherwise the dispute cannot be processed. All of the information required to open the dispute, as described above, must be provided before the expiry of the deadline indicated above.

  • After this period and failing to have complied with these formalities, the Products will be deemed to be compliant and free from any apparent defect and no complaint can be validly accepted by the Seller.

Undeliverable products

In the event of non-delivery due to an incorrect or incomplete address, or uncollected shipment, the Seller terminates the purchase contract. The purchase price will then be refunded to the Consumer less outward and return delivery costs.

Cancellations of an order by the Consumer

Orders cannot be canceled by the Consumer. This is an assurance for the Seller that the products contained in the Product Offerings will not be immobilized, nor prepared and sent for nothing. This allows the Seller to sell perishable goods or process Orders in the same way as when the products collected are directly from him.

Cancellation of a reservation by the Seller or by the Platform

Orders may be refused or canceled by the Seller under certain conditions at any time without giving reasons. However, the seller is required to cancel orders in exceptional circumstances. The Platform may refuse or cancel an order at its sole discretion and without giving any reason. In the event of cancellation, the Consumer is reimbursed for the sums collected during his Order.

Order modification

The Platform may modify an Order at its sole discretion and without giving any reason. It then reimburses the Consumer for the sums collected during the order, in order to resolve problems such as product unavailability or a dispute between the Consumer and the Seller. The platform then partially or fully reimburses the amounts received during the Order.

Returns and exchanges policy

Unless otherwise stated, returns and exchanges are not accepted.

Delivery areas

Delivery of orders is only available to Switzerland.

These regulations are offered to you in the language of your choice, however it is important to note that it is the French version of the document that controls and governs your use of the Mimelis services.
